There are times when I take this job too personal. Coming from a long line of law enforcement officers, this is my contribution to fighting crime without putting my life on the line. But sometimes I feel like a cop who has busted his butt to catch a thief only to see them beat the system on a technicality.
Not too long ago I received a call from a woman who was desperate for help and didn't know where to turn. She claimed that someone had forged her name to a warranty deed and was attempting to steal her house. Each time we talked she expressed her anger and depression at the situation. I almost felt like her therapist.
I found that the signature on the notarized deed was not hers. She wanted to know if the notary forged it, as she knew of him and said he "would do anything for a buck". Unfortunately, I was unable to give her the answer she wanted, as I didn't have sufficient evidence. Here in NC, it is not required for notaries to maintain a logbook so very few do.
I suggested the client file a complaint with the NC Secretary of State for the fraudulent endorsement by a notary. She did so with my written opinion to substantiate her claim. The state investigator informed me that the most severe punishment the notary would get would be his license revoked and 2 weeks community service, if that. Obviously our criminal justice system is broken.
There was little I could say to help her understand the absence of a serious penalty for attempting to steal her house. I realize it is not my job to enforce the law. I am an advocate for the documents, nothing more, nothing less.
So I simply had to be satisfied with the fact that I saved this woman from losing her home that she had lived in for 26 years. Not bad for a weeks work.
I guess we all can be the "person with the big white hat", not Superman.
